Two Types of Workers' Compensation Wrongful Death Claims

Surviving spouses and family members have two options for recovering workers' compensation benefits after losing a loved one because of an accident or disease acquired as a result of work. In the event of an accident, the facts and circumstances generally dictate the requirements of filing a successful claim. Circumstances often leave employers few options other than to approve the claim. There may also be circumstances that allow the surviving family members to file a civil lawsuit against a third party, such as the manufacturer of a defective product. The family may benefit from a settlement from workers' comp insurance, as well as a settlement with the liable third party.

Surviving family members may also sue for workers' compensation benefits in the event of a fatal illness contracted because of exposure to a harmful work environment. For example, thousands of asbestos workers have died after contracting mesothelioma, a type of lung cancer caused by asbestos fibers entering the lung walls. Plaintiffs will need to show a direct connection between the harmful work environment and the death. These types of claims require extensive understanding of complex medical conditions and the negligence that resulted in contracting the disease.
